In compliance with the European Digital Services Act (DSA), this policy outlines how we handle the removal of illegal content and content incompatible with platform Terms on our Services. It also explains how we protect the rights of users while ensuring compliance with European Union law.
This policy applies to all content created, shared, or hosted on Socrative, including text, images, videos, and any other media uploaded by users.
Content may be removed from Socrative when there is sufficient documentation to substantiate the following circumstances:
Illegal Content: Any material that violates EU law or the national law of an EU Member State, provided that the national law complies with EU law (e.g., hate speech, terrorism-related content, child exploitation, defamation, fraud, infringement of privacy, or intellectual property infringement).
Content Incompatible with Platform Terms: Content that is incompatible with Socrative’s Terms & Conditions of Service, including but not limited to abusive, harassing, misleading, or offensive material.
Socrative provides a notice-and-action mechanism to facilitate the reporting and removal of both illegal content and content incompatible with platform Terms. Users may report such content directly through the following form:
Each report is reviewed by our Privacy team and must specifically identify the content for removal, as well as provide a clear and substantiated explanation as to why the content is illegal or incompatible with our Terms.
When content is flagged for review:
User Notification: If content is removed, the user responsible for uploading the content will be notified with the reason for removal.
Right to Appeal: Users whose content has been removed will have the right to appeal the decision. Instructions on how to appeal content removal will be included in the notice to the user.
Transparency Reports: In compliance with the DSA, Socrative will publish annual transparency reports detailing the number of content removal requests, the reasons for removal, the average response time, and the outcomes of appeals. See more information here.
Socrative is committed to ensuring that any content removal process respects freedom of expression and other fundamental rights of users, as stipulated by the DSA. We ensure non-discriminatory enforcement of this policy, applying consistent standards across all user types and regions.
In some cases, content may be retained for longer periods:
Legal Obligations: If Socrative is required by law or in the interest of public safety or justice to preserve content, it may be retained or reported to relevant authorities.
Prevention of Harm: In situations where content poses a significant risk of harm to individuals or groups, we may act immediately without prior notice to the user.
